END USER LICENSE AGREEMENT (EULA) ​

Effective Date: July 7, 2026

This End User License Agreement ("Agreement") is a legal agreement between Hack LLC ("Hack LLC," "we," "our," or "us") and the individual or legal entity ("you") that downloads, installs, activates, accesses, or uses the Nikto software and related documentation (collectively, the "Software").

PLEASE READ THIS AGREEMENT CAREFULLY.

BY DOWNLOADING, INSTALLING, ACTIVATING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU ARE ACCEPTING THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND THAT ENTITY TO THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

THE SOFTWARE IS LICENSED, NOT SOLD. This Agreement grants only the limited rights expressly stated herein. Hack LLC retains all ownership and intellectual property rights in the Software.

1. Definitions ​

For purposes of this Agreement:

"Software" means the proprietary Nikto Platform software distributed by Hack LLC, including executable programs, scripts, plugins, signatures, configuration files, databases, documentation, license keys, updates, upgrades, patches, and any accompanying materials.

"Documentation" means any manuals, technical documentation, release notes, online documentation, or other written materials provided by Hack LLC.

"License" means the limited right to use the Software granted under this Agreement.

"Authorized User" means an individual or legal entity that has lawfully obtained a License directly from Hack LLC or an authorized reseller.

"Third-Party Components" means software, libraries, frameworks, or other components distributed with the Software that are owned by third parties and licensed under their own applicable license terms.

2. License Grant ​

Subject to your continued compliance with this Agreement and payment of all applicable license fees, Hack LLC grants you a limited, revocable, non-exclusive, non-transferable, non-assignable, and non-sublicensable License to install and use the Software solely for your own internal business or personal use.

The License does not grant ownership of the Software or any intellectual property rights.

Unless otherwise stated in your purchase agreement or license certificate, each License is limited to the number of users, systems, installations, or seats purchased.

You may make one archival backup copy of the Software solely for disaster recovery purposes, provided all copyright and proprietary notices remain intact.

Except as expressly granted in this Agreement, no other rights are granted by implication, estoppel, or otherwise.

3. License Restrictions ​

Except as expressly permitted by this Agreement or by applicable law that cannot legally be waived, you shall not, directly or indirectly:

3.1 Copying and Modification ​

  • Copy, reproduce, distribute, or publish the Software except as expressly permitted herein.
  • Modify, adapt, translate, or create derivative works based upon the Software.
  • Merge the Software into another product except as expressly authorized by Hack LLC.

3.2 Reverse Engineering ​

  • Reverse engineer, decompile, disassemble, decode, decrypt, or otherwise attempt to derive or discover the source code, algorithms, architecture, protocols, interfaces, file formats, detection logic, or other non-public aspects of the Software.

3.3 Redistribution ​

  • Sell, lease, rent, sublicense, assign, redistribute, transfer, or otherwise provide the Software to any third party.
  • Include the Software as part of another commercial offering.
  • Bundle the Software with another product without written authorization.

3.4 Hosted Services ​

You may not:

  • host the Software for third parties;
  • provide the Software as a managed service;
  • operate the Software as Software-as-a-Service (SaaS);
  • expose the Software through a web interface or API for third-party use;
  • offer scanning services powered primarily by the Software unless expressly licensed to do so.

3.5 License Circumvention ​

You shall not:

  • bypass or disable licensing mechanisms;
  • interfere with activation or license validation;
  • remove technical protection measures;
  • share license keys;
  • generate unauthorized license keys;
  • use unauthorized activation methods.

3.6 Competitive Use ​

You shall not use the Software, Documentation, or knowledge obtained from the Software to:

  • develop;
  • improve;
  • validate;
  • market;
  • support; or
  • test

any product or service that competes with the Software.

3.7 Benchmarking ​

Without Hack LLC's prior written consent, you may not publish or publicly disclose:

  • benchmark results;
  • comparative testing;
  • performance measurements;
  • competitive analyses; or
  • commercial reviews

of the Software.

This restriction does not prohibit private internal evaluations.

3.8 Artificial Intelligence ​

You shall not use the Software, Documentation, signatures, detection logic, metadata, output, or any portion thereof to:

  • train;
  • fine-tune;
  • validate;
  • evaluate;
  • optimize; or
  • improve

any artificial intelligence system, machine learning model, large language model, or similar automated technology.

3.9 Security Intelligence Products ​

Without prior written permission from Hack LLC, you may not use the Software to create, compile, aggregate, publish, license, or sell:

  • vulnerability intelligence databases;
  • internet-wide scanning services;
  • commercial fingerprint databases;
  • signature collections;
  • security intelligence feeds; or
  • similar commercial products whose value is substantially derived from operation of the Software.

3.10 Proprietary Notices ​

You may not remove, alter, obscure, or modify any:

  • copyright notice;
  • trademark;
  • patent notice;
  • proprietary legend;
  • attribution;
  • license information; or
  • other ownership marking.

3.11 Illegal Use ​

You may not use the Software in violation of applicable law or in a manner that infringes the rights of any third party.

4. Authorized Security Testing ​

The Software is intended for legitimate security assessment, vulnerability scanning, penetration testing, research, and defensive security purposes.

Nothing in this Agreement prohibits you from using the Software against systems, networks, or applications for which you have proper authorization.

You are solely responsible for obtaining all required permissions and ensuring that your use complies with applicable laws, regulations, contracts, and organizational policies.

Hack LLC does not authorize or encourage unauthorized access to computer systems and assumes no responsibility for unlawful use of the Software.

5. Ownership and Intellectual Property ​

The Software is licensed, not sold.

Hack LLC and its licensors retain all right, title, and interest in and to the Software, including:

  • copyrights;
  • patents;
  • trademarks;
  • trade secrets;
  • source code;
  • object code;
  • signatures;
  • databases;
  • plugins;
  • Documentation;
  • updates;
  • enhancements;
  • know-how; and
  • all other intellectual property rights.

No ownership rights are transferred under this Agreement.

All rights not expressly granted are reserved by Hack LLC.

6. Confidential Information ​

The Software contains confidential and proprietary information belonging to Hack LLC.

You agree to use reasonable care to protect the Software and any non-public technical information relating to it from unauthorized disclosure.

Nothing in this Agreement restricts disclosure required by applicable law, provided you give Hack LLC prompt notice where legally permitted.

7. License Keys and Accounts ​

License keys, activation codes, account credentials, and similar authentication mechanisms are confidential.

You may not:

  • disclose;
  • publish;
  • share;
  • sell;
  • transfer; or
  • permit others to use

your license credentials except as expressly authorized by Hack LLC.

You are responsible for all activity conducted using your license credentials.

8. Updates, Support, and Third-Party Components ​

Hack LLC may, but is not obligated to, provide updates, bug fixes, enhancements, patches, or new versions of the Software.

Unless accompanied by separate license terms, all updates are governed by this Agreement.

Hack LLC may discontinue updates or support for any version of the Software at any time.

Unless expressly included with your purchase or covered by a separate written support agreement, Hack LLC has no obligation to provide maintenance, consulting, technical support, or future updates.

The Software may include Third-Party Components licensed under separate open-source or commercial licenses. Those components remain subject to their respective license terms. Nothing in this Agreement modifies or replaces the licenses applicable to those Third-Party Components. Attribution and license notices for those components are set out in the Third-Party Notices.

9. Term and Termination ​

This Agreement remains in effect until terminated.

Your License automatically terminates if you fail to comply with any material provision of this Agreement.

Hack LLC may terminate this Agreement immediately upon written notice if you materially breach this Agreement and fail to cure such breach within thirty (30) days after receiving notice, unless the breach is incapable of cure, in which case termination may be immediate.

Hack LLC may also terminate any evaluation, trial, subscription, or time-limited License upon expiration of its applicable term.

Upon termination or expiration of this Agreement, you shall immediately:

  • cease all use of the Software;
  • uninstall and permanently delete all copies of the Software in your possession or control;
  • destroy all backup copies, except where retention is required by applicable law; and
  • discontinue use of any associated license keys, activation credentials, or online services.

Termination does not limit any other legal or equitable remedies available to Hack LLC.

The provisions relating to ownership, intellectual property, confidentiality, warranty disclaimers, limitation of liability, indemnification, export compliance, governing law, and any provisions intended by their nature to survive shall remain in effect following termination.

10. Compliance Verification ​

Upon reasonable written notice, Hack LLC may request information reasonably necessary to verify your compliance with this Agreement.

You agree to cooperate in good faith with such requests.

Hack LLC will not require disclosure of unrelated confidential business information and will use any information received solely for purposes of verifying license compliance.

11. Export Compliance ​

The Software is subject to the export control laws and regulations of the United States and may also be subject to the import or export laws of other jurisdictions.

You agree to comply with all applicable export control laws, sanctions programs, and regulations, including the U.S. Export Administration Regulations (EAR) and regulations administered by the Office of Foreign Assets Control (OFAC).

You represent and warrant that you are not:

  • located in a country or territory subject to comprehensive U.S. sanctions;
  • identified on any applicable U.S. government restricted-party list; or
  • prohibited from receiving the Software under applicable law.

You shall not export, re-export, transfer, or make the Software available in violation of applicable export control laws.

12. U.S. Government End Users ​

The Software is commercial computer software developed exclusively at private expense.

If acquired by or on behalf of the United States Government, the Software is provided only with the rights specified in this Agreement and, where applicable, the rights granted under the Federal Acquisition Regulation (FAR) and the Defense Federal Acquisition Regulation Supplement (DFARS) governing commercial computer software.

13. Disclaimer of Warranties ​

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS," "AS AVAILABLE," AND WITH ALL FAULTS.

HACK LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, QUIET ENJOYMENT, OR THAT THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION OR ERROR.

HACK LLC DOES NOT WARRANT THAT:

  • THE SOFTWARE WILL MEET YOUR REQUIREMENTS;
  • THE SOFTWARE WILL OPERATE WITHOUT INTERRUPTION;
  • THE SOFTWARE WILL DETECT EVERY SECURITY ISSUE OR VULNERABILITY;
  • THE SOFTWARE WILL BE FREE OF DEFECTS; OR
  • ANY ERRORS WILL BE CORRECTED.

YOU ARE SOLELY RESPONSIBLE FOR VALIDATING ALL RESULTS PRODUCED BY THE SOFTWARE.

14. Limitation of Liability ​

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HACK LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

  • INDIRECT DAMAGES;
  • INCIDENTAL DAMAGES;
  • SPECIAL DAMAGES;
  • CONSEQUENTIAL DAMAGES;
  • EXEMPLARY DAMAGES;
  • PUNITIVE DAMAGES; OR
  • LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, DATA, OR BUSINESS INTERRUPTION,

ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT, REGARDLESS OF THE LEGAL THEORY ASSERTED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HACK LLC'S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THE SOFTWARE OR THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID FOR THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR
  • ONE HUNDRED U.S. DOLLARS (US $100.00).

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

15. Indemnification ​

You agree to defend, indemnify, and hold harmless Hack LLC and its members, officers, employees, contractors, licensors, successors, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • your use or misuse of the Software;
  • your violation of this Agreement;
  • your violation of applicable law;
  • your infringement of the rights of any third party; or
  • any unauthorized or unlawful security testing conducted using the Software.

16. Injunctive Relief ​

You acknowledge that unauthorized copying, disclosure, distribution, reverse engineering, or misuse of the Software may cause irreparable harm for which monetary damages alone would be an inadequate remedy.

Accordingly, Hack LLC shall be entitled to seek temporary, preliminary, and permanent injunctive relief, specific performance, or other equitable remedies, in addition to any remedies available at law, without the necessity of posting bond where permitted by applicable law.

17. Privacy ​

Hack LLC may collect only the information reasonably necessary to provide licensing, activation, updates, support, or other services associated with the Software.

Any collection or processing of personal information shall be governed by Hack LLC's Privacy Policy, as published on its website and updated from time to time.

18. Force Majeure ​

Hack LLC shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, acts of government, war, terrorism, labor disputes, internet or telecommunications failures, cyberattacks, shortages of materials, or failures of third-party service providers.

19 Customer Scan Data and Artificial Intelligence ​

Hack LLC recognizes that scan results, configuration information, targets, and related data generated through your use of the Software may contain confidential or sensitive information.

Except with your express prior written consent, Hack LLC will not use your scan results, vulnerability data, target information, configuration data, or other customer-provided content to train, fine-tune, validate, evaluate, or improve any machine learning model, artificial intelligence system, large language model, or similar automated technology.

Hack LLC may use aggregated and anonymized operational information solely to maintain, troubleshoot, secure, license, or improve the Software, provided such information cannot reasonably be used to identify you, your organization, your systems, or your scan results.

Nothing in this section limits Hack LLC's ability to process customer data as necessary to provide the Software, perform technical support requested by you, comply with applicable law, or fulfill its contractual obligations.

19. Governing Law and Venue ​

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in the Commonwealth of Virginia.

Each party irrevocably submits to the personal jurisdiction of those courts and waives any objection based on improper venue or forum non conveniens.

20. Assignment ​

You may not assign, transfer, delegate, sublicense, or otherwise convey this Agreement or any rights granted under it without the prior written consent of Hack LLC.

Any attempted assignment in violation of this section is void.

Hack LLC may assign this Agreement in connection with a merger, acquisition, sale of assets, or corporate reorganization.

21. Entire Agreement ​

This Agreement constitutes the complete and exclusive agreement between you and Hack LLC regarding the Software and supersedes all prior or contemporaneous oral or written communications, proposals, understandings, or agreements concerning its subject matter.

Any purchase order or similar document issued by you shall have no legal effect unless expressly accepted in writing by Hack LLC.

22. Severability ​

If any provision of this Agreement is determined to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

The invalid provision shall be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its original intent whenever possible.

23. No Waiver ​

The failure of Hack LLC to enforce any provision of this Agreement shall not constitute a waiver of that provision or of any other provision.

Any waiver must be in writing and signed by an authorized representative of Hack LLC.

24. Amendments ​

Hack LLC may modify this Agreement from time to time.

For perpetual licenses, the version of this Agreement accepted at the time of purchase governs your use of that licensed version of the Software unless you voluntarily accept a later version.

For subscription-based or hosted services, continued use of the Software after the effective date of revised terms constitutes acceptance of those revised terms.

25. Electronic Acceptance ​

You acknowledge that your electronic acceptance of this Agreement, including by downloading, installing, activating, or using the Software, constitutes your legal agreement to its terms and has the same force and effect as a handwritten signature.
